Terms and Conditions
Effective date: October 30, 2026
These Terms and Conditions (“Terms”) govern your use of Atomic Automations, including our website at atomicautomations.ai, our CRM and marketing automation platform, and any concierge services (together, the “Services”). The Services are provided by Topflight Insurance Solutions LLC (“Atomic Automations,” “we,” “us”). By creating an account, completing a purchase, or using the Services, you agree to these Terms.
1. About Atomic Automations
Atomic Automations is a CRM and marketing automation platform for licensed insurance professionals. Atomic Automations is owned by Topflight Insurance Solutions. We provide software, templates and setup services. We are not an insurance company, we do not sell insurance, and we are not affiliated with or endorsed by Medicare or any government agency.
2. Eligibility
You must be at least 18 years old and able to enter a binding agreement to use the Services. The Services are intended for business use by insurance agents, agencies and their staff. Some plans, including Pro Concierge, are available only to agents contracted with Topflight Insurance Solutions.
3. Plans and pricing
We currently offer the following plans:
| Plan | Monthly | Yearly | Who it’s for |
|---|---|---|---|
| DIY | $97/month | $1,164/year | Open to every agent |
| Pro Concierge | $197/month | $2,364/year | Topflight agents only |
The price, billing frequency and any onboarding fee for your plan are shown at checkout before you complete your purchase. Prices are in US dollars and do not include taxes, which may be added where required. Advertising spend paid to Meta or other platforms is not included in any plan and is billed by those platforms directly.
4. Automatic renewal
Your subscription renews automatically. When you subscribe, you authorize us to charge your payment method at the start of each billing period, monthly or yearly depending on the plan you choose, at the price shown at checkout. Your subscription continues and renews automatically until you cancel.
For yearly plans, we will send a reminder to the email on your account at least 30 days before your renewal date.
5. Onboarding fee
Pro Concierge monthly plans include a one-time onboarding fee of $200, charged at checkout, which covers your initial setup work. The onboarding fee is waived for yearly plans. The onboarding fee is non-refundable.
6. How to cancel
You can cancel anytime by emailing [email protected] before your next billing date. Cancellation stops future charges. You keep access to the Services until the end of your current billing period. We do not provide refunds or credits for partial billing periods, unused time, or unused features, except where required by law.
7. Price changes
We may change our prices. If we do, we will notify you by email at least 30 days before the new price applies to your subscription. If you do not want to pay the new price, you can cancel before it takes effect.
8. Failed payments
If a payment fails, we may retry the charge and contact you to update your payment method. If payment is not received, we may suspend or end your access to the Services.
9. Your responsibilities and compliance
You are responsible for how you use the Services, including every message, ad, landing page and campaign sent or published from your account. This includes:
- Getting proper consent before you call, text or email anyone, as required by the Telephone Consumer Protection Act (TCPA), CAN-SPAM and state laws
- Following A2P 10DLC registration and carrier rules for business text messaging
- Following CMS marketing rules, including TPMO requirements, when you market Medicare products
- Following Meta’s advertising policies, including its rules for health and insurance ads
- Following state insurance laws and the rules of the carriers you represent
Our templates, automations and done-for-you content are starting points. You must review and approve any content before it is used, and you are responsible for confirming it meets the rules that apply to you.
10. Pro Concierge services
Pro Concierge includes the setup and ongoing services listed on our pricing page at the time of purchase. To deliver them, we need timely information, access and approvals from you. Delays on your side may delay delivery. Work outside the listed services is not included.
11. Your data
You own the contacts, messages and other data you add to the Services (“Your Data”). You give us permission to store, process and use Your Data only as needed to provide and support the Services. You are responsible for having the right to collect and use Your Data. Our Privacy Policy explains how we handle personal information.
12. Acceptable use
You agree not to use the Services to:
- Send spam or messages to people who have not consented to receive them
- Send false, misleading or deceptive content
- Break any law or regulation, or infringe anyone’s rights
- Upload malware or try to access accounts or systems you are not authorized to use
- Resell or share access to the Services without our written permission
We may suspend or end your account if we believe you have broken these rules.
13. Third-party services
The Services rely on third-party providers, including our CRM platform provider, payment processors, phone and SMS carriers, and advertising platforms such as Meta. Your use of those services may also be subject to their terms. We are not responsible for outages, policy changes or decisions made by those providers, including ad rejections, account restrictions or message filtering.
14. Intellectual property
We own the Services, including our software, templates, training content and Atomic University materials. While your subscription is active, you may use them for your own business. You may not copy, sell or redistribute them.
15. No guarantee of results
We do not guarantee any specific number of leads, appointments, sales or other results. Results depend on many factors outside our control, including your market, offer, budget and follow-up.
16. Disclaimers
The Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise the Services will be uninterrupted or error-free.
17. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to the Services is limited to the amount you paid us in the 12 months before the claim arose.
18. Indemnification
You agree to defend and indemnify us against any claims, fines or losses arising from your use of the Services, your content, or your violation of these Terms or any law, including TCPA, CMS or carrier rules.
19. Termination
You may cancel as described in Section 6. We may suspend or end your access if you break these Terms, fail to pay, or use the Services in a way that creates legal risk for us or others. When your access ends, you can request an export of Your Data within 30 days. After that, we may delete it.
20. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you by email or in the Services before they take effect. Continuing to use the Services after that means you accept the updated Terms.
21. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in Harris County, Texas.
